TITLE 4. THE PHILADELPHIA BUILDING CONSTRUCTION AND OCCUPANCY CODE
SUBCODE "A" (THE PHILADELPHIA ADMINISTRATIVE CODE)
SECTION A-105.0 RESPONSIBILITY
A-105.1 Maintenance: All equipment, systems, devices and
safeguards required by the current technical codes or by previous ordinances or
codes for the structure or premises when erected or altered, shall be maintained
in good working order. The requirements of the current technical codes are not
intended to provide the basis for removal or abrogation of fire protection and
safety systems and devices in existing structures.
Exception: This
section shall not prohibit the removal of fire protection systems or equipment
where such removal is authorized by an approved building permit and construction
documents for alterations and/or a change in Use Group, and the fire protection
systems or equipment are not required by the current building
code.
A-105.2 Owners: The owner shall be responsible for the testing,
maintenance and repair of structures and systems in accordance with the
maintenance provisions of this code and the technical
codes.
A-105.3 Occupant responsibility: If an occupant of a structure
creates conditions in violation of this code or the technical codes, by virtue
of any improper use of the premises or by virtue of storage, handling and use of
substances, materials, devices and appliances, the occupant shall be responsible
for the abatement of said hazardous conditions.
A-105.4 Transfer of
responsibility: A contract between owner and operator, operator and occupant, or
owner and occupant with regard to compliance with this code and the technical
codes shall not relieve any party of direct responsibility under such
codes.
A-105.5 Licensed trades: Prior to the issuance by the Department
of any new or annual licenses for trades and professions regulated by this code
or the technical codes, the license applicant shall show proof that the
applicant possesses the most recent edition of the relevant technical code and
update service.
