SECTION F-107.0 SPECIAL HAZARDS
F-[112.3.2 Special hazards] 107.1 General: In addition to
any other sanction or remedial procedure provided in [this] the administrative
code, any person who violates the provisions of Sections F-[112.3.2.1] 107.1.1
or F-[112.3.2.2] 107.1.2, or any regulations issued thereunder, shall be subject
to a fine as set forth herein for each provision violated. When the Fire
Department or the Department of Licenses and Inspections finds a violation of
Sections F-[112.3.2.1] 107.1.1 or F-[112.3.2.2] 107.1.2, that department shall
immediately issue a notice of violation. Such notice shall bear the date, time
and nature of the violation, identity and address of the violator, the amount to
be remitted in response to the notice of violation and the penalty which can be
imposed by the court for the violation, and shall be signed by the person
issuing the notice and shall bear the official identification number of the
person issuing the violation notice. For each violation and for each day a
violation continues, a separate notice of violation may be issued under this
section.
F-[112.3.2.1] 107.1.1 Hazards to egress: Whenever a code official
finds a violation of Sections F-605.0, F-606.1 or F-608.0 a notice of violation
requesting remittance in the amount of $100.00 for each condition or obstruction
shall be issued to the property owner, and the condition shall be immediately
corrected.
F-[112.3.2.2] 107.1.2 Failure to notify the Fire Department
of a fire alarm: When an investigation by a code official discloses that the
Fire Department has not been notified of the activation of a fire alarm, as
required by Section F-501.1.4, the violator shall be issued a notice of
violation requesting remittance in the amount of $300.00.

107.1.3 Payment for violation: Any person who receives a notice of violation may
within ten days, pay the cost, admit the violation, and waive appearance before
a Municipal Court Judge. The notice of violation shall contain an appropriate
statement for signature by the violator for the purpose of admitting the
violation and waiving a hearing, and shall be returned by the violator when
he/she remits the stipulated payment. Any payment made under this subsection
shall not relieve the violator of the responsibility for correcting the
violation set forth in the notice of violation.

Failure to pay: If a person who receives a notice of violation fails to pay the
prescribed payment within ten days of the issuance of the notice of violation, a
code enforcement complaint shall be issued for the violation in such manner as
provided by law. If the person named in the code enforcement complaint is found
to have violated this code or fails to appear on the date set for the hearing,
that person shall be subject to the imposition of fines in the amounts set forth
in Sections F-[112.3.2.1] 107.1.1 or F-[112.3.2.2] 107.1.2, plus court
costs.
F-[112.3.2.5] 107.1.5 Fines and court costs: Any fines or costs
imposed by the courts shall be entered as a judgment against the violator and
shall be paid within ten days of imposition. If the fine together with any court
costs is not paid within such period, the violator shall be subject to
proceedings for the contempt of court and/or collection of the fine as provided
by law.
