SECTION F-3103.0 FIRE SAFETY

F-3103.2 Violations: A person shall not manufacture, store, possess, offer for sale or expose for sale, sell at retail or discharge any fireworks.

Exception: Where approved for the supervised display of fireworks.

F-3103.3 Display. Approved displays shall be handled by an approved competent operator, and the fireworks shall be arranged, located, discharged and fired in a manner that will not be a hazard to property or endanger any person. The discharge of fireworks shall be conducted by persons possessing a license issued by a state or approved by the Fire Department.

F-3103.3.2 Halting of the display: The Fire Department shall have the right to be present at the firing of any fireworks display and shall have the right to cause the display to be stopped if it is not conducted in accordance with the provisions of this code and the requirements of the fireworks permit.

F-3103.4 Bond for display: The permit holder shall furnish a bond in an amount approved by the code official for the payment of all potential damage caused either to the person or property due to the permitted display, and arising from any acts of the permit holder or the agent of the permit holder.

Exception: In lieu of the required bond, the Department of Licenses and Inspections may accept a certificate of public liability and property damage insurance, in the same amount as the bond, from an insurance company authorized to write such insurance within the Commonwealth of Pennsylvania.

F-3103.5 Sale of Fireworks. (Delete text -- substitute as follows)

F-3103.5 Sale of fireworks: Hand-held wire coated sparklers may be sold to adults provided that the pyrotechnic composition of each sparkler does not exceed one hundred grams, does not contain any magnesium and devices containing any chlorate or perchlorate salts shall not exceed five grams of composition per item.
