(1) Prohibited Conduct. No person shall erect or maintain
any communication or other electrical transmission pole except as authorized by
special ordinance and in accordance with this Section.
(2) Permits. No
person shall erect or maintain any communications or other electrical
transmission pole unless he has obtained a permit from the Department of
Licenses and Inspections.
(a) No permit shall be issued
unless:
(.1) The applicant submits a plan specifying the number and
size of poles to be erected and their proposed locations;
(.2) The
plan has been approved by the Department of Public Property and the Department
of Streets;
(.3) The applicant pays an application fee of $10.00 per
pole, which shall entitle the applicant to a license for the year in which the
pole is erected.
[370] (.4) The
applicant agrees that the Department of Public Property shall have access to
portions of each pole for installation of the City's communication
facilities.
(3) Fees.
(a) The annual fee for each pole is
$1.50.
[371] (b) The owner of poles
erected pursuant to the provisions of this Section shall, before the first
Monday of January of each year, apply to the Department of Licenses and
Inspections for a license to maintain all poles erected prior thereto. Such
license shall be effective until the first Monday of the following
year.
[372] (4) Maintenance of
Poles.
(a) No pole shall be maintained which is found to be defective
or dangerous, as determined by the Department of Public
Property.
(b) Every pole shall be labeled in oil paint with the name or
initials of its owner and an identifying number.
(5) Attachment. All
persons, firms, or corporations now using or who may hereafter use or attach any
telegraph or telephone wires or electrical conductors or fixtures to poles
belonging in whole or in part to the City of Philadelphia shall pay to the City
Treasurer the sum of one (1) dollar annually for each and every attachment made
to each and every pole.
