TITLE 14. ZONING AND PLANNING
CHAPTER 14-1100. INSTITUTIONAL DEVELOPMENT DISTRICT
§14-1107. Use Conditions.
(a) No institutional development district shall be
established unless at the time of the introduction of the ordinance therefor,
the said ordinance is accompanied by a Development Plan as specified below,
containing a recommendation from the City Planning Commission with respect to
the layout of the entire area, and a recommendation from the Department of
Streets with respect to the traffic pattern plan, parking plan, and
driveways.
(b) Said Development Plan shall be submitted by the
proponent of the Plan to the City Planning Commission who shall refer a copy of
the Plan to the Department of Streets for their recommendation. Submission of
the Plan must be made at least 45 days before the proposed introduction of the
ordinance for the establishment of the District and shall contain as a minimum,
the following information and details:
(.1) Plans for the development
of the entire development district area, and not on a separate lot, parcel, or
block basis;
(.2) The extent, boundaries, and area of the proposed
Institutional Development District area, and the ownership of the land
therein;
(.3) The general dimensions and heights of the proposed
structures as well as the use or uses intended for each
structure;
(.4) The gross floor area of all buildings on the
plan;
(.5) Any proposed change to the existing confirmed street layout
within or surrounding the boundaries of the District;
(.6) The total
occupied area of the Institutional Development District area, expressed in
square feet and percentages;
(.7) The size and location of all
off-street parking areas; the size and location of all driveways leading
thereto; and the size and location of all other private drives, ways, or streets
intended to be used by automobile traffic;
(.8) The size and location
of all off-street loading facilities;
(.9) The size and location of
any signs;
(c) At any time after final adoption, any party at interest
may apply to the City Planning Commission for a change in the approved
Institutional Development District Plan; provided, that at the time said change
is requested, that an amended plan is submitted to the City Planning Commission
and the City Council. The City Planning Commission shall submit in writing to
the Council its recommendation regarding the amendments. Within 45 days of
receiving the written recommendation from the Commission, the Council shall
reply in writing informing the Commission as to the action the Council has taken
in approving, disapproving, amending, or deferring the change. If Council does
not reply in writing to the Commission within the aforementioned 45-day period,
Council's approval will be presumed. And further provided, than no change
shall be approved by the City Planning Commission which is contrary to the
criteria set forth in this Chapter or which permits a use not provided in this
Chapter.
