§14-217. "R-16" Residential District.


(1) Use Regulations. The specific uses permitted in this district shall be the erection, construction, alteration, or use of buildings and/or land for:

(a) The uses permitted in "R-14" Residential Districts, subject to all qualifications imposed on such uses;

(b) Attached residential dwellings of all classes permitted in any residential district.

(2) Area Regulations.

(a) Lot Width and Area. There shall be no required minimum lot width or area in this district.

(b) Occupied Area. Subject to all other provisions and requirements of this district, buildings may occupy up to 100% of the lot area, except that buildings of 5 stories or less shall occupy not more than 80% of the lot area on intermediate lots, and 90% of the lot area on corner lots.

(c) Open Area. Open area shall be determined by the other provisions and requirements of this district, except that buildings of five stories or less shall have an open area of not less than 20% of the lot area on intermediate lots and 10% on corner lots, which open area may consist of front, side or rear yards and open courts. Any open area shall comply with the minimum dimensions specified in (d), (e) and (f) of this section.

(d) Building Set-back Line. No building set-back line shall be required in this district, subject to the provisions of (e)(.1) below.

(e) Yards.

(.1) Front Yards and Side Yards Facing Streets. Any front wall or side wall of a structure containing one or more legally required windows shall be located so that every point of said wall shall be a minimum horizontal distance from the centerline of the street equal to one-half the height of said point above the average ground level at the base of the structure.

(.2) Other Side Yards and Certain Open Courts. Any side wall which does not face a street, and any open court which is not between the wings of the same building, containing one or more legally required windows shall be located so that the first five stories of said wall shall be a minimum horizontal distance of eight feet from the side lot line, and for each additional five stories or less of said wall, a minimum additional horizontal distance of eight feet from the side lot line shall be added. Any building having a side wall (regardless of height) which does not contain legally required windows need not have a side yard, but if a side yard is provided, it shall have a minimum width of eight feet (subject to exception, see § 14-104(12)).

(.3) Rear Yards. Any rear wall of a structure containing one or more legally required windows shall be located so that the first five stories of said wall shall be a minimum horizontal distance of 15 feet from the rear lot line, and for each additional five stories or less of said wall, a minimum additional horizontal distance of 15 feet from the rear lot line shall be added; provided, that where said wall faces upon a street, said distances may be measured from the centerline of said street, rather than the lot line. Any building have a rear wall (regardless of height) which does not contain legally required windows need not have a rear yard, but if a rear yard is provided, it shall have a minimum depth of 15 feet.

(f) Courts. Courts, when used, shall have minimum widths as follows:

(.1) The minimum width of open courts not between wings of the same building shall be not less than eight feet;

(.2) The minimum width of courts between wings of the same structure shall be determined by the following requirements:

(.a) For buildings of three stories or less and not in excess of thirty-five feet high, the minimum width shall be not less than the length or depth of such court.

(.b) For buildings over three stories or over thirty-five feet in height, whichever is less, the minimum width shall be not less than the length or depth of such court plus one-third of that portion of the height of the building over three stories or thirty-five feet.

(.3) The dimensions of an inner court shall be equal to the height of the higher wall between which each dimension of the inner court is being measured.

(3) Height Regulations. There shall be no height regulations except as height may be limited by the other applicable provisions of this district.

(4) Floor Area. No building in this district shall have a gross floor area (as defined in Section 14-102(25)) greater than that permitted under the provisions herein set forth:

(a) Basic Floor Area. Every building in this district shall be permitted a gross floor area equal to 500% of the area of the lot.

(b) Additional Floor Area. In addition to the Basic Floor Area, any building in this district shall be permitted additional gross floor area in accordance with the provisions of Chapter 14-1300.[32]
