TITLE 21. MISCELLANEOUS
CHAPTER 21-1200. POLICE ADVISORY BOARD.
§21-1201. Findings.
The Council hereby finds that:
(1) annual civil
judgments and settlements by the City of Philadelphia have exceeded a total of
over ten million (10,000,000) dollars for the past five (5) years in cases
involving alleged incidents of misconduct or abuse of civil rights, including
over three million (3,000,000) dollars in settlements of such cases in 1992
alone; and
(2) it is just as important that falsely accused police
officers be exonerated by a credible, independent investigative board as it is
that those properly accused be investigated by a credible, independent
investigative board; and
(3) most major cities in the United States of
America have established permanent independent review boards to investigate
allegations of police misconduct; and
(4) allegations of police abuse
have been a source of urban rioting and unrest in Los Angeles, New York City,
Atlanta, and other major cities in the United States of America;
and
(5) it is important to the maintenance of public confidence in
public safety and law enforcement to investigate allegations of police
misconduct and prevent police misconduct in the future; and
(6) the
appointment of a Police Advisory Board will work to prevent future incidents of
police misconduct and abuses of civil rights, reduce the amount of money needed
to satisfy judgments and settlements based upon allegations of police
misconduct, promote public confidence in law enforcement, and lessen the
possibility that future incidents of urban unrest will occur; and
(7) it
is clearly within the power of the Council and the Mayor by ordinance to create
advisory bodies within Charter created offices, departments, boards and
commissions which are mandated to conduct investigations and make
recommendations regarding matters within the jurisdiction of the agencies which
they advise; and
(8) many examples of the creation of such advisory
bodies by ordinance exist, including but not limited to the Minority Business
Enterprise Council, the Recycling Advisory Committee, and the Vacant Property
Review Committee; therefore:
